The Journalism Competition and Preservation Act (JCPA) of 2021 was introduced to the 117th Congress and aims to establish a temporary four-year safe harbor from antitrust laws for news outlets that allow publishers to negotiate collectively with digital content distributors, such as Google and Facebook. It has bipartisan support including Senator Amy Klobuchar and Senator Mitch McConnell.
This follows the passage of an Australian law late last month that forces tech giants to pay publishers for content. The Australian bill initially faced pushback from top tech companies but Facebook eventually agreed to invest $1 billion into various Australian news outlets. Currently, the US Bill would not be as aggressive as the Australian bill. The bill's current draft would benefit any print, broadcast, or digital news organization with a dedicated editorial staff that publishes weekly at a minimum.
